نعتزم الاعتماد على هذه الشروط وتفاصيل حجزك من أجل مصلحة الطرفين، الجراح وأنت.
في هذه الشروط، تعني الإشارة إلى “أنت” و”أنت” الشخص المذكور اسمه في تأكيد الحجز(الذي يجب أن يكون بالغاً السن القانونية).
تُعتبر وسائل الاتصال هي المكالمات الهاتفية والبريد الإلكتروني والرسائل المباشرة المرسلة منك/إليكِ من قبلك.
تشير التعبيرات المستخدمة في الوثيقة مثل “نحن” و”لنا” و”لنا” إلى مونو كلينيك.
تُشكِّل الشروط والأحكام التالية، إلى جانب حجزك، العقد المبرم بينك وبيننا طوال مدة إقامتك في إزمير تركيا لأغراض العلاج.
تنطبق التعاريف وقواعد التفسير التالية في هذه الشروط: التكاليف الإضافية؛ أي تكاليف أخرى تكون مسؤولاً عن دفعها بالإضافة إلى النفقات المتعلقة بالإجراءات. رسوم الإلغاء؛ رسوم نتقاضاها لتغطية نفقاتنا الإدارية بعد الإلغاء، نموذج الموافقة؛ يشير إلى نموذج التفويض الذي يخول عيادة مونو كلينيك فرض رسوم على دفعة الإيداع من خلال تفاصيل بطاقة الائتمان الخاصة بك لدفع الإيداع الذي سيكون جزءًا من إجمالي المبلغ الذي ستدفعه.
الاستشارة؛ يشير إلى التواصل الشفهي والفحص البدني الذي يجريه أحد الجراحين لدينا قبل إجراء الجراحة.
يشير العقد إلى الاتفاقية المبرمة بينك وبيننا، والتي تشمل الحجز وهذه الشروط والأحكام؛ تشير الباقة إلى حزمة الخدمات التي اتفقنا على تقديمها لك والتي تم تحديدها في خط سير الرحلة بوضوح قبل وصولك.
تشير الإقامة إلى الإقامة والخدمات التي نقدمها لك من تاريخ البدء إلى تاريخ المغادرة، كما هو محدد في خط سير الرحلة;

  1. العناصر التالية مغطاة في الحزمة الخاصة بك؛
    1.1 التشاور مع الجراح في تركيا وإجراءات التجميل نفسها،
    1.2 النقل الخاص من نقطة الالتقاء في مطار إزمير إلى فندق Aftercare أو الفندق الشريك ونقل العودة من الفندق الشريك إلى مطار إزمير،
    1.3 التنقلات داخل المدينة من وإلى مكان الإقامة لجميع المواعيد مع الجراح،
    1.4 وجبة الإفطار إذا كانت الإقامة في فندق AfterCare.
    1.5 مترجم فوري يشير إلى الشخص القادر على التواصل باللغة الإنجليزية أو السويدية والألمانية وهو متاح 7/24 أثناء إقامتك،
    1.6 الوصول إلى واحد أو أكثر من الموظفين الناطقين باللغة الإنجليزية أثناء إقامتك،
    1.7 جميع اختبارات الدم السابقة للعملية الجراحية والبروتوكول الروتيني المطبق عليك،
    1.8 الملابس الطبية المتعلقة بالعلاج الذي تم تلقيه،
    1.9 الإقامة خارج المستشفى (مدة الإقامة قابلة للتعديل حسب العلاج الذي تلقيته)،
    1.10 مستشفى بين عشية وضحاها تصل إلى ليلتين.
    1.11 تأمين السفر المجاني
    2. العناصر التالية غير متضمنة في الحزمة الخاصة بك؛
    2.1 الرحلات الجوية من/إلى تركيا – ستحتاج إلى تغطية نفقات رحلتك بنفسك، وتكون مسؤولاً تجاه نفسك عند اختيار التذاكر المرنة أو الترويجية التي تمكن أو تمنع إجراء تغييرات على الرحلات الجوية المراد حجزها،
    2.2 تكاليف جواز السفر والتأشيرة،
    2.3 لا يتم تضمين وجبات الغداء والعشاء في حالة كون الفندق الشريك هو مكان الإقامة (في حالة عدم توفرها في فندق الرعاية اللاحقة.
    2.4 مرافقة نفقات الشخص بأي وسيلة،
    3. قبل السفر؛
    3.1 يجب عليك تزويدنا بما يلي،
    3.1.1 نسخة من أي وصفات طبية لديك والتي تحدد أي دواء تحتاجه و/أو تتناوله حاليًا، وأي تعليمات صادرة عن الممارس،
    3.1.2 تفاصيل الاتصال في حالات الطوارئ وتفاصيل الاتصال بأقرب أقربائك.
    يُرجى ملاحظة أن تركيا ليست جزءًا من الاتحاد الأوروبي، وبالتالي لا ينطبق عليها نظام الصحة الأوروبي,
    3.1.3 تفاصيل رحلتك الداخلية والخارجية،
    4. حجز الإجراء (الإجراءات) التجميلية الخاصة بك والإقامة؛
    4.1 بمجرد أن نتلقى مقدمك ومعلومات رحلتك، سنرسل إليك تأكيدًا بالبريد الإلكتروني لحجزك،
    4.2 يبدأ سريان العقد بيننا بمجرد إرسالنا تأكيد الحجز إليك.
    ويشكّل تأكيد الحجز وهذه الشروط والأحكام العقد,
    4.3 إذا لم نتمكن من قبول حجزك لبعض الأسباب بعد ذلك، فسنعيد إليك مبلغ التأمين الخاص بك في أقرب وقت ممكن بشكل معقول، وعلى أي حال خلال 21 وواحد وعشرين يومًا من تاريخ الاستلام.
    5. من المتوقع منك أن تقدم لنا؛
    5.1 بياناتك الشخصية،
    5.2 حالتك الصحية الحالية وجميع معلومات التاريخ الطبي السابقة،
    5.3 تفاصيل الاتصال بأقرب أقربائك،
    5.4 تفاصيل جواز السفر،
    5.5 مهم – إذا لم تزودنا بهذه المعلومات في غضون هذه المهل الزمنية، أو إذا قدمت معلومات غير كاملة أو غير صحيحة، فستكون مسؤولاً عن أي أضرار قد تحدث.
    نحن نحتفظ بالحق إما في إنهاء العقد بأثر فوري، أو فرض رسوم إضافية بمبلغ معقول لتعويضنا عن أي عمل إضافي مطلوب نتيجة لذلك.
    لن نكون مسؤولين عن تقديم الحزمة في وقتٍ لاحق على السعر المتفق عليه أو عدم تقديم أي جزء من الحزمة إذا كان ذلك بسبب عدم تزويدنا بالمعلومات التي نحتاجها في غضون فترة زمنية معقولة من طلبنا لها.
    6. الدفع.
    6.1 سيكون سعر باقتك هو الرسوم الموضحة في تأكيد الحجز الخاص بك.
    وسوف نضمن بأفضل ما لدينا أن يكون السعر الذي تم تقديمه لك صحيحاً,
    6.2 بعد الموافقة على نوع الإجراء (الإجراءات) التجميلية وتاريخ تحديد موعد الإجراء، من المتوقع أن تدفع لنا وديعة/رسوم حجز لا تزيد عن 10% من إجمالي السعر الذي تم تحديده لباقة العلاج التي ستدفعها إما عن طريق التحويل المصرفي أو عن طريق البريد,
    6.3 يجب عليك دفع باقي الرسوم وأي تكاليف إضافية في موعد لا يتجاوز تاريخ إجراء (إجراءات) التجميل الخاص بك،
    7. التغييرات والإلغاءات التي قمت بها؛
    7.1 سنحاول استيعاب أي تغييرات معقولة ترغب في إجرائها على مسار رحلتك طالما أنك تقدم لنا إشعاراً معقولاً في وقتٍ مبكر.
    إذا كنا قادرين على استيعاب مثل هذه التغييرات، فسنعلمك إذا كان ذلك ممكناً وسنبلغك بأي تعديلات على الرسوم أو الجداول الزمنية للخدمات أو أي شيء آخر قد يكون ضرورياً نتيجة للتغيير الذي طلبته.
    يجب عليك أن تؤكد خطياً ما إذا كنت ترغب في المضي قدماً في التغيير.
    أنت تقبل وتعلن مسبقاً أن مونو للجراحة التجميلية لا تتحمل أي مسؤولية حتى يتم إرسال تأكيد الحجز المعدل إلينا بناءً على موافقتك الخطية على التغييرات التي ترغب في إجرائها على خط سير الرحلة، وأن الاتفاق سيبدأ عندما نرسل تأكيداً خطياً بهذا التغيير.
    7.2 إذا تمكنا من إجراء التغيير (التغييرات) المطلوبة على حجزك، فإنك توافق على دفع أي تكاليف إضافية تتعلق بهذه التغييرات.
    7.3 نحن، في عيادة مونو Clinic Mono، نعمل على ضمان إجراء العملية الأكثر صحة وراحة لمرضانا وتوفير أكثر الظروف راحة أثناء وصولهم ومغادرتهم وإقامتهم في تركيا.
    ولهذا السبب، نتلقى مدفوعات الإيداع من مرضانا.
    بمجرد أن يدفع المريض الوديعة، نبدأ في ترتيب تفاصيل الإقامة والنقل وتفاصيل العملية.
    ولهذا السبب، إذا رفض المريض القدوم إلى عيادة مونو وإلغاء العملية بعد دفع العربون، فإننا نتكبد خسائر مالية حيث إننا قد رتبنا بالفعل الإقامة والمواصلات والجدول الزمني للعمليات.
    ولذلك، فإن أي إلغاء يطلبه المريض سيخضع لرسوم الإلغاء التي تبلغ 75% من مبلغ الإيداع، وسيتم استرداد الـ 25% المتبقية من إجمالي مبلغ الإيداع بشرط عدم تحديد موعد الجراحة بعد.
    إذا تم حجز موعد العملية الجراحية وطلب استرداد المبلغ، فلن يتم استرداد المبلغ المدفوع وسيكون إجمالي الإيداع هو التكلفة الغارقة.
    7.4 يرجى ملاحظة أن العقد قد اكتمل عندما انتهينا من تقديم الحزمة وقمت بالدفع بالكامل.
    7.5 في حالة إجبارك ظروف خارجة عن إرادتنا على تقصير إقامتك أو تمديدها، يرجى ملاحظة أنك ستكون مسؤولاً عن أي تكاليف وخدمات وأعمال إضافية نتكبدها أثناء إقامتك، بشرط أن تكون هذه التكاليف الإضافية معقولة وضرورية. .
    8. التغييرات والإلغاء من جانبنا؛
    8.1 إذا تأخر إجراء عملية التجميل الخاصة بك أو تم تأجيلها لسبب خارج عن سيطرتنا، فسوف نتصل بك في أقرب وقت ممكن لإعلامك بذلك.
    شريطة أن نفعل ذلك، لن نكون مسؤولين عن التأخير الناجم عن الحدث، ولكن إذا كان هناك خطر تجاوز 30 (ثلاثين) يوماً من التأخير، يحق لك إنهاء العقد واسترداد المبلغ المدفوع.
    8.2 يجوز لنا إجراء تغييرات على الإجراءات التجميلية لتعكس التغييرات في القوانين والمتطلبات التنظيمية ذات الصلة.
    سنخبرك بالتغييرات الطفيفة التي لا تغير بشكل كبير المعلومات التي قدمناها لك عن إقامتك أو باقة الخدمات قبل تاريخ الإجراء (الإجراءات) التجميلية.
    8.3 في حالة حدوث مثل هذه التغييرات أثناء إقامتك، فسنقوم باتخاذ ترتيبات بديلة للامتثال قدر الإمكان للوصف الوارد في خط سير الرحلة والباقة.
    8.4 أنت تقر وتوافق على أننا لسنا مسؤولين تجاهك أو تجاه أي طرف ثالث عن الخسارة أو الضرر الذي تسببه أنت أو خسارة إقامتك، عندما تنشأ ظروف خارجة عن سيطرتنا.
    8.5 ننصحك بالتأكد من أن جميع حجوزات الرحلات التي تجريها فيما يتعلق بإقامتك يمكن تغييرها دون أن تتحمل أي تكلفة ونحن غير مسؤولين عن دفع أي تكاليف سفر إضافية أو أي تكاليف أو نفقات أو خسائر أخرى تتكبدها نتيجة أي تغيير أو إلغاء في الظروف المبينة، مثل التغييرات في مواعيد الرحلات أو ترتيبات السفر الأخرى.
    9. متطلبات جواز السفر والتأشيرة والصحة؛
    9.1 يرجى ملاحظة ما يلي بعناية:
    9.1.1 يجب عليك التأكد من أن جواز سفرك صالح لمدة 6 (ستة) أشهر على الأقل بعد تاريخ المغادرة المقترح؛
    9.1.2 يجب عليك التقدم للحصول على أي تأشيرة ضرورية في الوقت المحدد؛
    9.1.3 تقع على عاتقك مسؤولية الحصول على تأشيرة للدخول إلى تركيا.
    يمكنك الحصول على تأشيرة عند وصولك إلى تركيا أو يمكنك بدلاً من ذلك الحصول على تأشيرة إلكترونية عبر الإنترنت قبل المغادرة.

    9.1.4 في حالة عدم قبولك في تركيا ، أو في حالة الترحيل، سيتم تطبيق أحكام الإلغاء الواردة في هذه الشروط والأحكام وستكون الوديعة المدفوعة بمثابة تكلفة ثابتة بالنسبة لك.
    9.1.5 يجب عليك مراجعة طبيبك لمعرفة ما إذا كانت هناك حاجة إلى أي لقاحات و/أو أدوية، وإتاحة الوقت الكافي للحصول عليها.
    10. تفاصيل السفر؛
    10.1 قبل أسبوعين (أسبوعين) تقريبًا من تاريخ الإجراء المتفق عليه، سنقوم بتأكيد جميع التفاصيل المتعلقة بإقامتك.
    وستشمل هذه المعلومات ما يلي:
    10.1.1 مطار الوصول ووقت وتاريخ الاستلام
    10.1.2 الإجراءات والسعر (الرصيد المتبقي)
    10.1.3 تاريخ ووقت الإجراء والاستشارة والفحص
    10.1.4 عنوان المستشفى والعيادة
    10.1.5 جميع جهات الاتصال في حالات الطوارئ ومعلومات الاتصال الخاصة بمنسق المريض الخاص بك
    11. الإقامة؛
    11.1 أنت مسؤول عن إخطارنا مسبقًا في حالة مشاركة أحد المرافقين في إقامتك
    11.2 أغطية إقامتك؛
    11.2.1 المبيت والإفطار في الرعاية اللاحقة أو الفندق الشريك
    12. مسؤوليتنا عن الخسارة أو الضرر الذي لحق بك؛
    12.1 نحن مسؤولون تجاهك عن الخسائر والأضرار المتوقعة التي نتسبب فيها.
    إذا أخفقنا في الالتزام بهذه الشروط، فنحن مسؤولون عن الخسارة أو الضرر الذي تتكبده والذي يكون نتيجة متوقعة لإخفاقنا في هذا العقد أو فشلنا في استخدام العناية والمهارة المعقولة، ولكننا لسنا مسؤولين عن أي خسارة أو ضرر غير متوقع.
    تكون الخسارة أو الضرر متوقعاً إذا كان من الواضح أنه سيحدث أو إذا كنا نحن وأنت على علمٍ باحتمالية حدوثه وقت إبرام العقد.
    13. متنوعة.
    13.1 الملحق -1 “نموذج تقييم التخدير هو ملحق لهذا العقد وبالتالي يشكل جزءًا من هذا العقد.
    13.2 في حالة وجود نزاع بيننا، فإنك تتعهد بمحاولة تسوية النزاع من خلال المشاركة بحسن نية معنا في عملية الوساطة قبل البدء في التحكيم أو التقاضي.
    13.3 هذا العقد بينك وبيننا.
    ولا يحق لأي شخص آخر إنفاذ أي من شروطه ما لم ينص العقد صراحةً على خلاف ذلك.
    13.4 لا يجوز لأي من الطرفين التنازل عن حقوقه والتزاماته بموجب هذا العقد أو نقلها دون الحصول على موافقة كتابية مسبقة من الطرف الآخر.
    13.5 سيتم الاحتفاظ بجميع السجلات الطبية للمرضى التي نتلقاها بسرية تامة في ملفات إلكترونية آمنة ولن يتم الكشف عنها لأطراف ثالثة.
    13.6 يعمل كل بند من بنود هذه الشروط بشكل منفصل.
    وإذا أصبح أي بند (بنود) من هذا العقد لاغياً وباطلاً لأي سبب من الأسباب، تظل البنود المتبقية سارية المفعول والتأثير الكامل.
    13.7 تخضع هذه الاتفاقية وتفسر وفقًا لقوانين الجمهورية تركيا وأي إجراءات قانونية تتعلق بهذا العقد يجب أن يتم تقديمها إلى السلطة القضائية لمحاكم إزمير ومكاتب التنفيذ، دون تفعيل تعارض مبادئ القانون الخاصة بها. .
    14. قبل الإجراء؛
    14.1 أنت توافق على الامتثال لقرار الجراح إذا أدت فحوصات الدم التي تجريها قبل إجراء العملية إلى إلغاء الجراحة أو تأجيلها بسبب رأي الطبيب المختص الذي يجبر على إجرائها في وقت لاحق أو عدم إجرائها.
    وعليه، يُقترح عليك الكشف عن أي معلومات تتعلق بتاريخك الطبي السابق والحالي بشفافية.
    15. الحملات.
    15.1 قد نقوم في بعض الأحيان بتضمين تكاليف الرحلات الجوية في الباقة التي تحجزها، حيث يتم إرسال إشعار مسبق عن تشغيل الحملة لك مسبقًا، إذا لم يتم إبرام العقد معك في إطار الحملة المذكورة، فهذا يعني أنه غير قابل للتطبيق حاليًا، أما إذا قمت بإبرام العقد معنا في إطار الحملة المذكورة أعلاه، فستكون الحملة بميزانية تكاليف طيران تصل إلى 250 جنيه إسترليني وستتم تغطية تكاليف تذاكر الطيران التي تزيد عن المبلغ المحدد من قبلك.
    16-سوءالممارسة؛
    في حالة حدوث سوء الممارسة الجراحية؛ في حالة حدوث سوء الممارسة الجراحية، سيتم إجراء جراحة تصحيحية على يد أحد الجراحين لدينا وستكون مجاناً.
    أنت تقبل وتقر بأن المصاريف المرتبطة بالإجراء ستتم تغطيتها من قبلك.
    17. صور ما قبل وبعد الصور
    أنت توافق على تفويض المسؤولين في العيادة والموافقة على استخدام صورك قبل وبعد العلاج، والتي سيُطلب منك مشاركتها معنا لأغراض المتابعة.
    يمكن استخدام الصور التي لا تكشف عن هويتك لأغراض الدعاية ونشرها على جميع صفحاتنا على مواقع التواصل الاجتماعي وموقعنا الإلكتروني.

  • The contract to be signed between the parties is a Medical Service Brokerage Agreement.
  • The information of the Intermediary ( i.e. the Agency) is as follows:

  • The patient is thoroughly informed about the operation both before the operation, during booking and when he/she arrives in Turkey for treatment, and informed consent texts are read. The operation is performed only and solely after the Patient has read, understood and signed the said consent texts. Therefore, it is not possible for the Patient to claim that he/she did not know the matters written in the consent texts. The Patient is obliged to read the consent texts carefully and accept the operation by understanding the complications and risks that may occur.
  • The patient must be over 18 years of age, i.e. of legal age, to enter into a contract with the Agency and for the operation to be performed. Otherwise, the consent of the legal guardian is required and they must be present at all times.
  • The Agency will take all necessary steps to fulfill its contractual obligations and to ensure the satisfaction of the Patient. Accordingly, the Agency will send the Patient a confirmation e-mail via mail or whatsapp or similar communication methods regarding the reservation once the deposit fee has been paid and the flight details have been submitted to the Agency.
  • Travel insurance is included in the package unless otherwise agreed by the parties. However, it is recommended that the Patient take out insurance for the remaining issues.
  • If the Patient’s explicit consent is obtained, before and after photos of the Patient’s operation will be shared on the Agency’s various social media accounts and website. The Patient has the right to withdraw this consent at any time. In such a case, the photos will be removed promptly.
  • A deposit is taken in order to provide better service to the patients and to complete the preparations with third parties, relevant institutions and doctors before the Patient’s arrival in Turkey. The deposit fee will be paid by the Patient by bank transfer, 3D or mail order. If the Patient fails to pay the deposit, the Agency has the right to unilaterally terminate the contract or postpone the operation.
  • The rest of the payment can be made via by bank transfer, 3D, Western Union, cash or mail order.
  • In the event that the name of the cardholder differs from that of the patient, the payment shall be processed through a 3D Secure system, and the cardholder shall be deemed to have approved the relevant payment. Responsibility in this regard shall rest with the patient, and no refund request may be made, nor may any objection or dispute be raised against the payment, on the grounds of such difference.
  • The accuracy of the information entered on the payment screen by the patient or the patient’s relative in relation to the patient is solely the responsibility of the patient. In the event that false, incomplete, or misleading information is provided, the Agency shall bear no liability, and no claim of any nature may be asserted against the Agency arising from or in connection with the provision of such incorrect information.
  • Certain information must be submitted to the Agency by the Patient prior to booking and operation. The Patient shall be responsible for the accuracy of this information.
  • Fees are determined on a package basis, and the price and package content are determined according to the procedures to be performed on the Patient and the rights that the Patient will benefit from. The price of the package is stated on the booking confirmation. Additionaly, The Patient is responsible for any and all additional and out-of-package costs that may arise.
  • The patient must be aware that the entering into the contract creates an obligation to make a payment.
  • The full package fee must be paid at the latest on the date of the operation and the Patient will be in default if this payment is not made. In such a case, the Agency has the right to cancel the services covered by the package.
  • Although the patient has the right of withdrawal within the scope of the law on consumer protection, any cancellations requested by the patients within 2 weeks after the sale is made will be subject to cancellation fee which is 75% of deposit payment, and the remaining 25% of total deposit payment will be refunded conditioned not to schedule a surgery date yet. If a surgery date is booked and refund requested, no refund will be applicable and total deposit will be the Patient’s sunk cost. If the cancellation is made after 2 weeks of the sale, no deposit will be refunded.
  • In the event that the Customer requests to withdraw from the Agreement, the process shall operate as follows: the withdrawal notice shall be submitted by the Customer via email, message or written letter sent to the contact details specified in Article 2 of this preliminary information text, and thereafter, if the conditions set forth under Article 14 are met, the deposit shall be refunded.
  • The Patient is personally liable for any delay caused by him/her.
  • The Agency is an intermediary medical tourism organization, not a healthcare organization. The Agency does not provide the medical service itself, nor does it operate or control the service provided. Treatment is carried out under a contractual relationship between the Patient and the treating physician. The Patient acknowledges that the Agency is not medically qualified and is not responsible for any medical procedure provided through the Agency’s chosen physician and for the medical consequences of such procedure. The Agency shall not be responsible or liable for any abuse, negligence or other claims, complications, dissatisfaction that may arise directly or indirectly from any care, treatment or other services provided by the physician or his/her recommendation.
  • The package and operation details are determined in the first instance on the basis of the information provided remotely by the Patient. For this reason, the Patient’s treatment plan may change when the Patient is physically examined by a physician. The Patient has the right to refuse this new plan. However, in such a case, the refund will be made by deducting the deposit and the expenses incurred until then.
  • The Agency stores the Patient’s personal data, including medical records, with the utmost sensitivity. The Agency does not use or disclose, sell or rent this data for any other purpose. The Agency is committed to complying with applicable data protection legislation in Turkey to ensure Patient confidentiality. It may be used to promote the patient’s before and after treatment pictures, to improve the Agency’s website, to provide patients with the necessary services and results of treatments, and to conduct research and analysis for product development. At the same time, the Patient will be asked to sign a Personal Data Protection clarification text and an explicit consent text, and the data will be processed as described in these texts.
  • The Patient, who is a consumer, has the right to apply to the Consumer Court or the Consumer Arbitration Committee in case of any violation of the law.

ARTICLE 1 – PARTIES

1.1.This Medical Service Brokerage Agreement (“Agreement”) has been concluded between Clinic Mono (“Agency”) (MERSIS No: 0608063486800001, a health tourism intermediary organization located in Folkart Towers A Kule Adalet Mah. Manas Bulv. No:47/B K:20 D:2009 35535 Bayraklı/İzmir (+90 544 852 45 26 – [email protected]), and the service recipient (“Patient”). The Parties will be referred to as the Agency and the Patient respectively and together as the Parties.

ARTICLE 2 – DEFINITIONS

2.1. Agency: Refers to Clinic Mono, which acts as an intermediary agency in health tourism.

2.2. Patient: The person who is a party to the contract and who will be treated by coming to Turkey with health tourism

2.3.Terms and Conditions: Refers to this contract

2.4. Package: The package is the service details agreed upon by the Agency and the Patient, specifying which services will be provided, how and at what price.

2.5. Procedure: It is the operation to be performed on the patient

2.6. Website: The website of the Agency, which is: https://clinicmono.com/

2.7. Deposit: It is a prepayment to be received from the Patient and is necessary for the Agency to make the necessary arrangements.

ARTICLE 3 – SUBJECT

3.1. This contract sets out the details, terms and conditions of the package deal between Clinic Mono, an intermediary agency in the field of health tourism, and the Patient. By approving this contract, the Patient expressly accepts and undertakes that he/she has read this Terms and Conditions Agreement fully and has been clearly informed about the matters contained in the contract and accepts these terms.

3.2. Within the scope of this contract, the Patient accepts, declares and undertakes that he/she has provided his/her identity and contact information and medical information correctly and that he/she does not have any health and/or travel disabilities. The Patient is obliged to sign the consent forms and the documents writing his/her full and correct name and surname in the official records. In the event that the Patient provides false or incomplete information, the Agency will not have any responsibility, and in such a case, the Patient is responsible for any damages incurred by the Agency or third parties.

ARTICLE 4 – PACKAGE FEE, PAYMENT AND DEPOSIT

4.1. Fees are determined on a package basis, and the price and package content are determined according to the procedures to be performed on the Patient and the rights that the Patient will benefit from.

4.2. The Patient is responsible for any additional and out-of-package costs that may arise due to reasons arising from the Patient. Similarly, If the Agency has to pay additional costs due to the Patient’s inability to benefit from travel, accommodation and transportation or health services on the dates agreed in this Agreement, such additional cost shall be paid immediately by the Patient to the Agency.

4.3. The price of the package is stated on the booking confirmation. This price includes the matters listed in article 4.1 of this agreement.

4.4. A deposit is taken in order to provide better service to the patients and to complete the preparations with third parties, relevant institutions and doctors before the Patient’s arrival in Turkey. The deposit fee will be paid by the Patient by bank transfer, 3D, Western Union, mail order, cash.

4.5. If the Patient fails to pay the deposit, the Agency has the right to unilaterally terminate the contract. Again, the Agency is not responsible for delays due to non-payment of the deposit.

4.6. The full package fee must be paid at the latest on the date of the operation and the Patient will be in default if this payment is not made. In such a case, the Agency has the right to cancel the services covered by the package.

4.7. Once the deposit is paid by the patient, the Agency immediately starts preparations and makes reservations such as hotels and hospital rooms. The matters concerning the refund of the deposit and the right of withdrawal from the Agreement are regulated under Article 5.1 of this Agreement.

4.8. After the payment is made and the operation is performed, the Patient agrees and undertakes that he/she cannot request a refund on the grounds that he/she is not satisfied with the result. What to do in case of dissatisfaction is explained in Article 6 of this contract, and the complaint process will be operated as stated in the said article and the Agency will decide whether a refund is required after this process.

4.9. If the patient wishes to make the payment by credit card, he/she agrees to pay a commission up to the rate determined in accordance with legal regulations.

4.10. In the event that the Patient refuses to sign any contract or document after the reservation is made, fails to fulfill the agreed and signed obligations, refuses to have the operation, doesn’t come to Turkey or similar situations, the operation will not be performed and the deposit and the expenses incurred by the Agency (and the Doctor) in this process will be deducted from the price paid by the Patient and the remaining amount will be refunded.

4.11. The Patient will incur additional charges for any pre-operative tests considered necessary because of a pre-existing or new condition. If the test results or preliminary examinations are unfavorable and the operation is canceled because it is deemed dangerous, the deposit and the expenses incurred by the Agency in this process will be deducted from the price paid by the Patient and the remaining amount will be refunded.

4.12. The Patient will inform the Agency if the Patient makes the payment by credit card in the name of a third party and not in his/her name or the third party will make the payment on his/her behalf. In such a case, the Patient shall be deemed to have undertaken the third party’s knowledge and consent and shall indemnify the Agency if the Agency suffers any loss as a result thereof.

4.13. The patient will be able to receive treatment within 12 months of paying the deposit. However, if the Patient does not come to Turkey for any reason within 12 months after the payment of the deposit, the deposit will not be refunded and if the Patient decides to receive treatment after 12 months, the deposit payment will be taken again. It should also be noted at this point that although the Patient may come for treatment within 12 months, the Agency will use reasonable endeavors to adhere to the agreed terms in the event that the Patient does not come at the originally agreed time. However, the Patient acknowledges that there is no guarantee in this respect.

4.14. In the event that the name of the cardholder differs from that of the patient, the payment shall be processed through a 3D Secure system, and the cardholder shall be deemed to have approved the relevant payment. Responsibility in this regard shall rest with the patient, and no refund request may be made, nor may any objection or dispute be raised against the payment, on the grounds of such difference.

ARTICLE 5 – RIGHT OF WITHDRAWAL, CANCELLATION, CHANGES, TERMINATION AND REFUND

5.1. Although the patient has the right of withdrawal within the scope of the law on consumer protection, any cancellations requested by the patients within 2 weeks after the sale is made will be subject to cancellation fee which is 75% of deposit payment, and the remaining 25% of total deposit payment will be refunded conditioned not to schedule a surgery date yet. If a surgery date is booked and refund requested, no refund will be applicable and total deposit will be the Patient’s sunk cost. If the cancellation is made after 2 weeks of the sale, no deposit will be refunded.

5.2. In the event that the Customer requests to withdraw from the Agreement, the process shall operate as follows: the withdrawal notice shall be submitted by the Customer via email, message or written letter sent to the contact details specified in this Agreement, and thereafter, if the conditions set forth under Article 5.1 are met, the deposit shall be refunded.

5.3. The Agency, while not guaranteeing anything, will try to accommodate any reasonable changes that the Patient wishes to make on his/her itinerary as long as he/she gives the Agency reasonable notice ahead of time. In such a case, the Agency will let the Patient know if this is possible and inform him/her of any alterations to either the Fees, the timescales of the services, or anything else which would be necessary as a result of the requested change. The Patient is required to confirm in writing whether he/she wishes to go ahead with the change. The Patient is also required to pay for any additional costs relating to such changes.

5.4. In the event that circumstances beyond the Agency’s control force the Patient to shorten or extend his/her stay, the Patient will be liable for any additional costs, services and work incurred by the Agency during the Patient’s stay.

5.5. The Agency may make changes to the Procedures to reflect changes in relevant laws and regulatory requirements. The Agency shall inform the Patient about small changes which do not significantly alter the information given to the Patient about his/her stay or Package before the Procedure(s) date.

5.6. If such changes occur during the Patient’s stay, while not guaranteeing anything, the Agency will make alternative arrangements so as to comply as closely as possible with the description in the itinerary and the Package.

5.7. In case the operation cannot be performed on the agreed day due to any reason originating from the hospital or the doctor, a new day will be determined. In such a case, the Agency will not have any responsibility and at the same time, except for the provisions of force majeure, this situation will not be considered as a valid reason for the Patient to terminate the contract.

5.8. The Patient may request a postponement of the operation date with at least 30 days’ notice before the operation. In such a case, the Agency will take reasonable efforts to make such a change, however, if postponement is not possible, the Agency shall have no liability and the Patient shall not be entitled to terminate the contract for just cause. If a change is possible, the Patient will be informed and written consent will be obtained. The Patient agrees that in the event of such a change, if there are additional costs, the Patient will be required to cover these costs. The deposit will not be refunded if the requested change is not possible.

5.9. It has been accepted by the Patient that if the Patient buys the flight ticket to Turkey through the Agency and cancels it later, there may be no refund or a refund may be made with deductions due to the principles of the transportation company, tax deductions, etc.

 ARTICLE 6 – UNDESIRED RESULTS, COMPLICATIONS AND COMPLAINTS

6.1. The patient is thoroughly informed about the operation both before the operation, during booking and when he/she arrives in Turkey for treatment, and informed consent texts are read. The operation is performed only and solely after the Patient has read, understood and signed the said consent texts. Therefore, it is not possible for the Patient to claim that he/she did not know the matters written in the consent texts. The Patient is obliged to read the consent texts carefully and accept the operation by understanding the complications and risks that may occur.

6.2. The patient understands and accepts that different complications may occur during any operation in medical science, that they may be caused by many different reasons (such as the patient’s existing disease), and that these cannot be considered malpractice unless the doctor is seriously negligent.  In any case, the addressee of medical claims and complaints such as malpractice is not the Agency, but the doctor or health institution providing the service.

6.3. The patient also understands and accepts that definitive results cannot be guaranteed in the field of medical science and especially in the field of aesthetics, and that the same procedure may look different in different people due to the physical characteristics of each individual, therefore, the fact that she/he does not like the result will not mean a violation of the terms of the contract or malpractice in the absence of any operational error.

6.4. The patient has been informed that the result of the operation may not be exactly as he/she would like, for example, the same result as in a reference photograph may not be possible to achieve due to the physical characteristics of the patient. Accordingly, the Patient understands and agrees that, in the absence of malpractice, he/she cannot claim a refund or similar claims solely because he/she does not like the result or because an ordinary complication has occurred.

6.5. In any case, The Agency shall not be liable for any complication or undesirable result due to the Patient providing the Agency with incorrect or incomplete information regarding the Patient’s medical history, medical condition, substance use, drug use, allergies, etc., and the Patient shall not be entitled to a refund or compensation.

ARTICLE 7 – BREACH OF CONTRACT

7.1. In the event of a breach of this Agreement by the Patient, the Agency shall no longer be obliged to fulfill its contractual obligations.

7.2. In the event that the Agency suffers any damage due to the Patient’s breach of the contract, the Patient shall compensate the Agency for the damages. In such a case, the Agency has the right to terminate the contract with a just cause and the deposit will not be refunded.

7.3. Force majeure circumstances regulated in Article 19 of this contract shall not constitute a breach of contract for the parties.

ARTICLE 8 – PATIENTS RIGHTS AND RESPONSIBILITIES

8.1. Certain information must be submitted to the Agency by the Patient prior to booking and operation. The Patient shall be responsible for the accuracy of this information, and in case of failure to provide accurate information, the Patient shall be fully liable, similarly, if the Patient provides incorrect or incomplete information about his/her medical condition, medical history, substance use, medication use, piercings etc., the Agency shall not be responsible in any way for the failure of the operation, the occurrence of unexpected complications and any damage to the Patient, and the Agency shall not be liable in any way, and no compensation, etc. shall be requested from the Agency. The Patient has been thoroughly informed that any complications that may occur in such a case will in no way constitute malpractice.

8.2. Similar to the above article, in the event of incorrect or incomplete information in the Health Check form and similar forms to be filled in by the Patient, all liability belongs exclusively to the Patient.

8.3. In the event that the patient fails to provide the information requested by the Agency in a timely manner or if it is found that incomplete or incorrect information has been provided, the Agency has the right to terminate the contract immediately or to change the content of the package without any compensation or refund. The patient hereby agrees to these conditions.

8.4. Without limitation, the Patient must provide the Agency with accurate and complete information, including but not limited to the following information and such other information as may be requested by the Agency:

  • Personal information of the Patient,
  • Passport information of the Patient,
  • A copy of any prescriptions the Patient has which sets out any medication that he/she require and/or is currently taking, and any instructions issued by practitioner,
  • Information on current and past diseases, previous surgeries, allergies, drug and substance use, piercings etc.
  • Emergency contact details and those of his/her next of kin. It must be noted that Turkey is not part of the EU and, as such, the European Health Scheme is not applicable,
  • The Patient’s inbound and outbound flight details,

8.5. Patient has to;

  • Make sure that his/her passport is valid for at least 6 (six) months after the proposed Departure Date,
  • Making the necessary visa applications on time,
  • Consult his/her doctor if any vaccination and/or medication is required.

In the event that the Patient is unable to enter Turkey or is deported due to non-compliance with these requirements or fails to meet the medical requirements, the Agency shall have no liability whatsoever and the deposit will not be refunded. In the event that the Patient misses the flight despite meeting these requirements, the Patient shall bear the responsibility.

8.6. The accuracy of the information entered on the payment screen by the patient or the patient’s relative in relation to the patient is solely the responsibility of the patient. In the event that false, incomplete, or misleading information is provided, the Agency shall bear no liability, and no claim of any nature may be asserted against the Agency arising from or in connection with the provision of such incorrect information.

8.7. The Patient is obliged to make payment as specified in this Agreement. In return, the Agency is obliged to fulfill its contractual obligations. The Patient is personally liable for any delay caused by him/her. If this delay causes any additional costs or liabilities to the Agency, the Patient must pay these costs and expenses to the Agency immediately. If a delay caused by the Patient results in a postponement of the operation, the Agency will use its reasonable best endeavors to plan accordingly in the interests of customer satisfaction and consumer rights, but this will not constitute an obligation, particularly in the case of delays caused by the Patient’s fault, and the Agency will use its best efforts in good faith.

8.8. The patient must be over 18 years of age, i.e. of legal age, to enter into a contract with the Agency and for the operation to be performed. Otherwise, the consent of the legal guardian is required and they must be present at all times.

8.9. If there will be an accompanying person during the stay, the Agency must be informed in advance.

8.10. If the authorized physician finds the operation risky according to the results of the tests performed before the operation, this will not be considered a breach of contract, and the Patient is obliged to comply with this decision due to the Agency’s obligation to protect the Patient’s health and interests.

8.11. If additional tests are required due to the patient’s pre-existing condition, exposure to or susceptibility to a condition, the Patient shall bear the costs of these additional tests. That being said, the Agency is only an intermediary and has no responsibility for such medical procedures.

ARTICLE 9 – AGENCY’S RIGHTS AND RESPONSIBILITIES

9.1. The Agency is an intermediary medical tourism organization, not a healthcare organization. The Agency does not provide the medical service itself, nor does it operate or control the service provided. Treatment is carried out under a contractual relationship between the Patient and the treating physician. The Patient acknowledges that the Agency is not medically qualified and is not responsible for any medical procedure provided through the Agency’s chosen physician and for the medical consequences of such procedure. The Agency shall not be responsible or liable for any abuse, negligence or other claims, complications, dissatisfaction that may arise directly or indirectly from any care, treatment or other services provided by the physician or his/her recommendation.

9.2. The Agency will take all necessary steps to fulfill its contractual obligations and to ensure the satisfaction of the Patient. Accordingly, the Agency will send the Patient a confirmation e-mail via mail or whatsapp or similar communication methods regarding the reservation once the deposit fee has been paid and the flight details have been submitted to the Agency.

9.3. The Agency is not responsible for situations beyond the Agency’s control, such as loss of belongings, and the Patient is expected to take due care in this regard.

9.4. The Agency is obliged to inform the Patient about accommodation and operation information 2 weeks before the operation date. This information is as follows:

  • arrival airport and pick-up time and date
  • procedures
  • procedure & consultation & control date and time
  • hospital & clinic address
  • contact details of all emergency contacts and patient coordinator

9.5. The Patient irrevocably accepts, declares and undertakes that the Agency does not have any legal obligation other than the intermediary service for the health services to be provided to him/her and that he/she shall hold the Agency harmless from any material and moral damages that may arise from health services. In any case, the patient’s addressee is not the Agency, but the doctor or health institution providing the service.

9.6. The package and operation details are determined in the first instance on the basis of the information provided remotely by the Patient. For this reason, the Patient’s treatment plan may change when the Patient is physically examined by a physician. The Patient has the right to refuse this new plan. However, in such a case, the refund will be made by deducting the deposit and the expenses incurred until then.

9.7. If the Patient wishes to proceed with a new treatment plan, Agency will provide a revised quote taking into account the doctor’s and hospital’s costs, such as new accommodation and travel costs. Agency is not liable for any irregularities, impossibilities and additional costs that may arise due to the Patient’s change of treatment plan.

9.8. As an intermediary, the Agency does not operate or control the services provided by doctors, hospitals, hotels, travel or transfer companies. By accepting the Agreement, the Patient acknowledges that the Agency is only an intermediary and that the service provided by third parties and any damages arising from that service are not covered by any warranty by the Agency.

9.9. In the event that the operation has to be postponed due to third parties such as hospitals, doctors, hotels, etc., the Agency does not have any responsibility as it is only an intermediary institution.

ARTICLE 10 – FEEDBACK, REVIEW AND NON-DISPARAGEMENT

10.1. By accepting this agreement, the Patient agrees, represents and undertakes that he/she will not attack or criticize the Agency or any of its employees, associates or partners in a manner that exceeds freedom of expression and amounts to defamation or libel on review websites, social media networks, blogs, public forums, etc. in relation to the treatment and actions of the Agency, doctor, hospital or third parties.

10.2. Feedback is always welcomed as long as it does not reach the level of insult or defamation.

ARTICLE 11 – LIABILITY IN RESPECT OF THIRD PARTIES

11.1. The Agency is an intermediary medical tourism organization, not a healthcare organization. The Agency does not provide the medical service itself, nor does it operate or control the service provided. Treatment is carried out under a contractual relationship between the Patient and the treating physician. The Patient acknowledges that the Agency is not medically qualified and is not responsible for any medical procedure provided through the Agency’s chosen physician and for the medical consequences of such procedure. The Agency shall not be responsible or liable for any abuse, negligence or other claims, complications, dissatisfaction that may arise directly or indirectly from any care, treatment or other services provided by the physician or his/her recommendation.

11.2. The patient agrees and accepts that the Agency does not have any legal liability or obligation to indemnify the damage in case of any damage caused by third parties such as hotels, hospitals, doctors, etc.

11.3. Similarly, the Agency shall not be liable if the Patient loses any of his/her belongings in hotels, hospitals, etc.

ARTICLE 12 – INSURANCE

12.1. Travel insurance is included in the package unless otherwise agreed by the parties. However, it is recommended that the Patient take out insurance for the remaining issues.

ARTICLE 13 – CHANGES TO THE TERMS AND CONDITIONS

13.1. Agency has the right, in its sole discretion, to change the terms in these Terms & Conditions at any time. The Patient will be notified as soon as possible if the change is substantial and there is an ongoing contractual relationship with the Patient. However, the Agency has the discretion as to what constitutes a substantial matter. The Patient’s continued use of the Agency will constitute a tacit acceptance of the new terms.

ARTICLE 14 – SEVERABILITY AND WAIVER

14.1. If any clause(s) of this Agreement becomes invalid for any reason, the remaining clauses shall remain in full force and effect.

14.2. The failure of a party to claim a right under the contract or to require the other party to fulfill its obligation shall not constitute a waiver of the said right.

ARTICLE 15 – PROTECTION OF PERSONAL DATA

15.1. The Agency stores the Patient’s personal data, including medical records, with the utmost sensitivity. The Agency does not use or disclose, sell or rent this data for any other purpose. The Agency is committed to complying with applicable data protection legislation in Turkey to ensure Patient confidentiality. It may be used to promote the patient’s before and after treatment pictures, to improve the Agency’s website, to provide patients with the necessary services and results of treatments, and to conduct research and analysis for product development. At the same time, the Patient will be asked to sign a Personal Data Protection clarification text and an explicit consent text, and the data will be processed as described in these texts.

ARTICLE 16 – CONFIDENTIALITY

16.1. The parties agree and declare that the information provided to them is confidential, that they will keep such information confidential in accordance with the Law on the Protection of Personal Data, and that they will not share the information with any institution or organization without the consent of the other Party. Agency is not under any legal obligation or liability for sharing information in cases where information sharing is a legal obligation in accordance with legal regulations or in cases of urgency for the performance of this Agreement. The Agency also has the right to process data as specified in the protection of personal data clarification text and explicit consent text.

ARTICLE 17 – SOCIAL MEDİA

17.1. If the Patient’s explicit consent is obtained, before and after photos of the Patient’s operation will be shared on the Agency’s various social media accounts and website. The Patient has the right to withdraw this consent at any time. In such a case, the photos will be removed promptly.

ARTICLE 18 – INTELLECTUAL PROPERTY RIGHTS

18.1. All content, graphics, format, design, user interface and other copyrighted materials on the Site and in any media owned by the Agency are protected by copyright law and other intellectual property laws and are owned by the Agency. The materials on the Site other platforms are available for informational

ARTICLE 19 – FORCE MAJEURE

19.1. In addition to general force majeure situations (strike, war, pandemic, etc.), the Agency’s inability to fulfill its contractual obligations due to the actions of third parties such as doctors, hospitals, hotels, etc. will be considered as force majeure. In case of force majeure lasting more than 90 days, both parties have the right to terminate the contract. In such a case, the deposit will not be refunded. If any other payment other than the deposit has been made by the patient, the remaining balance amount will be refunded after deducting all expenses incurred.

ARTICLE 20 – DISPUTE RESOLUTION AND EVIDENTIAL AGREEMENT

20.1. In the event of a contractual or operational dispute, the parties will prioritize the peaceful resolution of the dispute in good faith and, if necessary, with the assistance of a mediator.

20.2. In the event of any dispute arising out of this Agreement, the official records (including but not limited to whatsapp messages, mails, internet records, provider records and GSM operator records, etc)  of the Agency shall serve as evidence.

ARTICLE 21 – GOVERNING LAW

21.1. In any case, the laws of the Republic of Turkey will be applied in disputes that may arise from this contract and Izmir Courts and Izmir Enforcement Offices are hereby authorized.

ARTICLE 22 – FINAL PROVISIONS

22.1. The “Anesthesia Assessment Form” is an attachment to this Agreement and therefore constitutes part of this Agreement.

22.2. Neither party may transfer or assign its rights and obligations under this Agreement without the prior written consent of the other party.

CUSTOMER CLARIFICATION TEXT

According to the Personal Data Protection Law No.6698 (hereinafter referred to as the “Law No.6698”), LAL YAPI TUR. SEY. ORG. SAN. VE TİC. A.Ş.  is the Data Controller because he processes your personal data. According to Article 10 of the Law regulating the Obligation to Inform, data controllers are obliged to inform the real persons whose personal data they process on certain issues.

As you are the person concerned with this awareness, we process your personal data as explained below and within the limits prescribed by the legislation. As a Data Controller, we would like to inform you in accordance with Article 10 of the law titled “Data Controller’s Obligation to Inform”.

    1. Name, surname, Turkey Republic ID number, passport information, if you are a foreign citizen, your passport number or temporary Turkey Republic ID number, your place and date of birth, your marital status, your gender information and the Turkey Republic ID card or Driver’s License photocopy,
    2. Your contact and location data such as address, location, phone number, e-mail address,
    3. Your financial data such as your bank account number, IBAN number,
    4.
